Description of Proposal: The proposal is to construct a new building for Cummins Northwest totaling approximately 56,000 square feet on a 7.14-acre undeveloped site located within the industrial area of the City of Sumner. The building will include approximately 33,300 square feet of truck service space, 10,400 square feet of office space, 8,000 square feet for a parts department, and 4,250 square feet for a quick-serve facility. The project will include clearing and grading, new building, landscaping, parking areas, extension of utilities, stormwater system, and a public connection to the Sumner multi-use regional trail system. The project is located within the shoreline jurisdiction of the White River; therefore, a Shoreline Substantial Development Permit and a Shoreline Conditional Use Permit are also required.

The original Mitigated Determination of Non-Significance (MDNS) was issued 5/24/16. This modified MDNS is issued to clarify the details of City requirements in 2 conditions of approval related to street frontage improvements, as shown below. This does not revise the SEPA checklist or project plans submitted by the applicant.

  1. The project shall comply with the project’s approved Habitat Management Plan, dated March 2016.
  2. A final mitigation plan for the riparian buffer enhancement, including landscaping plans per SMC 18.41, shall be provided and approved prior to permit issuance.
  3. The multi-use public access trail shall be constructed by the applicant concurrently with site development. The trail shall comply with City of Sumner development standards for a multi-use regional trail. This includes repairs/modifications to existing curb, storm drainage and pavement, and construction of a new landscape strip and 14-foot wide trail. Additional right-of-way shall be dedicated to encompass the required landscape strip and trail. The Sumner Link multi-use trail is planned to pass through this project adjacent to the Fryar Avenue frontage. To construct the trail, this project must remove and relocate the existing westerly vertical concrete curb on Fryar Avenue so that the new curb is installed with the face of curb at the center of the existing fog line which will remove the existing westerly bike lane and remove the existing westerly sidewalk. Storm drainage relocation and pavement repair will be required. From the back of this new curb westerly will be constructed 5 feet of planter strip landscaped per city standards. From the westerly edge of the new landscape strip will be constructed 12’ of asphalt multi-use trail per city standards. From the westerly edge of the new multi-use trail will be constructed 2’ of level shoulder. The new right-of-way line will be located at the west edge of the level shoulder. Additional right-of-way must be dedicated to encompass the section described above. At each end of the project frontage, transitions will be made to existing multi-use infrastructure.
  4. The project shall install illumination along Fryar Avenue that complies with City of Sumner development standards, installation requirements, and illumination levels. This project will install illumination as required along Fryar Ave to bring the illumination levels up to city standards. The illumination will be designed and installed by Intolight/PSE.
  5. The proposed stormwater outfall shall comply with permitting, design, and other regulatory requirements of federal and state agencies. The applicant shall demonstrate compliance with those regulations prior to construction of the new outfall.
  6. At the time of building permits, the applicant shall pay all applicable City parks and trails fees.
